AN ACT To establish. develop. and maintain a public park in the municipality of San Juan to be known as «Munoz Rivera Park.»
Be it enacted by the •Legislature of Porto Rico: Section 1. That the Commissioner of the Interior is hereby instructed and directed to execute and sign a deed of cession and conveyance in favor of the municipality of San Juan of a parcel of land belonging to the People • of Porto Rico and located in the third zone of the barrio of Puerta de Tierra, measuring approximately twenty-seven and two-tenths °nudes, or an area of ten hectares, sixty-nine ares, eighteen centares, and six square decimeters, which parcel is bounded on the south by Ponce de Leon Avenue, formerly insular road number one: on the north, east, and west by lands of the Federal Reservation. The deed of cession and conveyance shall state the metes and bounds shown on a plan of said parcel of land approved by the Executive Council of Porto Rico July third, nineteen hundred and seventeen.
SEC. 2. That acceptance of the parcel of land referred to in section one of this act carries with it the obligation on the part of the municipality of San Juan to establish, develop. preserve, and maintain permanently over the full extension of the aforesaid parcel of land a public park to be known as «Munoz Rivera Park.• At no time and under no pretext shall said lands or any part thereof be applied to a purpose other than that expressly determined in this act.
SEC. 3. That «Munoz Rivera Parks’ shall be organized by a commission to be known as the Park Commission. composed of seven members, to wit: The Commissioner of the Interior, the Commissioner of Agriculture and Labor, three councilmen designated by the Municipal Council of San .Juan, the mayor, and the engineer of the said city.
SEC. 4. That within the ninety days following the date on which this act takes effect, the Park Commission shall submit to the Municipal Council of San Juan a general plan or project of works. including _proper distribution and location of fences, promenades, plazas. roads, sidewalks, gardens, trees, monuments, including a statue of the patriot Luis Munoz Rivera, fountains, buildings for recreation; and for the service of said park, and such other works as may be adaptable to the purposes and which shall provide greater attraction to the public and specially to children.

Sec. 5. That upon approval by the Municipal Council of San Juan of the general plan for the establishment of Munoz Rivera Park,» the works shall be carried on periodically and shall be chargeable to an annual appropriation of not less than $10,000, $5,000 to be necessarily appropriated by the municipality in its annual budget and the other $5,000 to be turned over annually by the treasurer of Porto Rico to the municipality of San Juan during ten consecutive years, beginning with the fiscal year nineteen hundred and eighteen-nineteen: Provided, That if within any fiscal year the item of $10,000 shall not have been totally expended the surplus remaining shall not be devoted to any other purpose and shall form part of a fund to be known as the SItifioz Rivera Park Fund.» to be expended in subsequent fiscal years.
SEC. 6. That there is hereby appropriated the sum of $50.000 from any funds in the Insular Treasury not otherwise appropriated, to be delivered to the municipality of San Juan for the purpose of carrying out the provisions of this act, in annual installments of $5,000 lie-ginning with the fiscal year 1918-19: Provided That the Treasurer of Porto Rico shall only make delivery of said Amounts after the municipality of San Juan has included equal sums of money in its regu-lar supplementary budgets to be expended on «Munoz Rivera Park.»
SEC. 7. That all laws or parts of laws in conflict herewith are hereby repealed. SEC. 8. That this act shall .take effect ninety days after its approval. Approved, November 30, 1917.

UNA ACTA Para establecer. desarrollar. y mantener un parque público en el municipio de San Juan que se conocerá como «Parque Muñoz Rivera».
Promulgase por la Legislatura de Puerto Rico: Sección 1. Que por la presente se instruye y ordena al Comisionado del Interior a otorgar y firmar una escritura de cesión y traspaso a favor del municipio de San Juan de una parcela de terreno perteneciente a del Pueblo • de Puerto Rico y ubicado en la tercera zona del barrio de Puerta de Tierra, mide aproximadamente veintisiete y dos décimas ° desnudos, o un área de diez hectáreas, sesenta y nueve áreas, dieciocho centares y seis cuadrados decímetros, cuya parcela limita al sur con la Avenida Ponce de León, antigua vía insular número uno; al norte, este y oeste con terrenos de la Reserva Federal. La escritura de cesión y traspaso expresará las medidas y límites mostrados en un plano de dicha parcela de terreno aprobado por el Consejo Ejecutivo de Puerto Rico el tres de julio de mil novecientos diecisiete.
SECCION. 2. Que la aceptación de la parcela de terreno a que se refiere el apartado uno de esta ley conlleva la obligación por parte del municipio de San Juan de establecerla, desarrollarla. preservar y mantener permanentemente en toda la extensión de la mencionada parcela de terreno un parque público que se conocerá como «Parque Muñoz Rivera». En ningún momento y bajo ningún pretexto dichos terrenos o cualquier parte de ellos se utilizarán para un propósito distinto al de expresamente determinado en esta ley.
SECCION. 3. Que los «Parques de Muñoz Rivera» serán organizados por una comisión que se conocerá como Comisión de Parques, compuesta por siete miembros, a saber: El Comisionado de Gobernación, el Comisionado de Agricultura y Trabajo, tres concejales designados por el Consejo Municipal. de San Juan, el alcalde y el ingeniero de dicha ciudad.
SECCION. 4. Que dentro de los noventa días siguientes a la fecha en que entre en vigor esta ley, la Comisión del Parque presentará al Consejo Municipal de San Juan un plan general o proyecto de obras. incluyendo adecuada distribución y ubicación de vallas, paseos, plazas. caminos, aceras, jardines, árboles, monumentos, incluida una estatua del patriota Luis Muñoz Rivera, fuentes, edificios para recreación; y para el servicio de dicho parque, y aquellas otras obras que se adapten a los fines y que proporcionen mayor atractivo al público y especialmente a los niños.

SECCION.. 5. Que una vez aprobado por el Concejo Municipal de San Juan el plan general para el establecimiento del Parque Muñoz Rivera, las obras se realizarán periódicamente y serán con cargo a una asignación anual no menor de $10,000, debiendo ser necesariamente $5,000. asignado por el municipio en su presupuesto anual y los otros $5,000 a ser entregados anualmente por el tesorero de Puerto Rico al municipio de San Juan durante diez años consecutivos, comenzando con el año fiscal mil novecientos dieciocho diecinueve: Disponiéndose, que si dentro de cualquier año fiscal la partida de $10,000 no se habrá gastado totalmente, el excedente restante no se dedicará a ningún otro propósito y formará parte de un fondo que se conocerá como Fondo del Parque Muñoz Rivera.» que se gastarán en ejercicios fiscales siguientes.
SECCION.. 6. Que por la presente se asigna la suma de $50,000 de cualesquiera fondos del Tesoro Insular no asignados de otro modo, para ser entregados al municipio de San Juan con el propósito de llevar a cabo las disposiciones de esta ley, en cuotas anuales de $5,000 respectivamente. a partir del año fiscal 1918-19: Disponiéndose que el Tesorero de Puerto Rico sólo hará la entrega de dichas Cantidades después de que el municipio de San Juan haya incluido sumas iguales de dinero en sus presupuestos suplementarios regulares para ser gastados en el «Parque Muñoz Rivera». «.
SECCION.. 7. Que por la presente se derogan todas las leyes o partes de leyes que entren en conflicto con la presente.
SECCION. 8. Que la presente ley entrará en vigor noventa días después de su aprobación. Aprobado el 30 de noviembre de 1917.
